Welcome to Hamari Laado App! HLF App is a platform by Hamari Laado Foundation for users to access information relating to Hamari Ladoo Foundation’s Neev© program.

HLF App enables coaches to record and track session progress, track student progress and session details and for the master coach to ensure all coaches are following the curriculum as expected hereinafter collectively referred to as Services.

Purpose

Hamari Laado Foundation recognizes the expectations of Users with regard to privacy, confidentiality and security of their personal information that resides with Hamari Laado Foundation through HLF App. Keeping personal information secure and using it solely for activities related to HLF App and preventing any misuse thereof is a top priority of Hamari Laado Foundation. HLF App has adopted the privacy policy aimed at protecting the personal information entrusted and disclosed by You [“the Policy”]. This Policy governs the way in which HLF App collects, uses, discloses, stores, secures and disposes of personal information.

This Privacy Policy is published in compliance of provisions of the Information Technology Act 2000 and Rules notified thereunder/ the Digital Personal Data Protection Act 2023 (‘DPDPA’) for collection, use, disclosure and retention of Personal Information. Your Personal Data is also processed in accordance with the DPDPA.

<< Currently, the privacy policy is issued under the IT Act 2000 and the Rules notified thereunder. Once DPDPA is implemented the Privacy Policy would be governed by DPDPA.>>

Scope

The Privacy Policy sets out:

  • The type of information/data collected from You
  • The purpose, means and modes of usage of such information/data
  • How and to whom HLF App may disclose such information/ data
  • How will the information/data be retained by HLF App

Applicability

The Policy is applicable and binding on all Users hereinafter referred to as “You”.

This Policy is applicable to personal data collected by HLF App from You

You are expected to read and understand the Privacy Policy, so as to ensure that You have the knowledge of:

  • the fact that the information/data is being collected;
  • the purpose for which the information/data is being collected;
  • the intended recipients of the information/data;
  • the name and address of the entity that is collecting the information/data and the entity that will retain the information/data ; and
  • the various rights available to such Users in respect of such information/ data

    1. USE OF INFORMATION BY HLF (PURPOSE)

    Use of Personal Data HLF to determine applicability>>

    • Manage your relationship with HLF App.
    • Provide user benefits, including session services, running kits, snacks, shoes, and other resources to facilitate successful sessions.
    • Promote or market activities of HLF.
    • Communicate with you for other purposes.
    • Enable you to effectively use the HLF App.
    • Perform analytics, such as studying user behaviour.
    • Enhance the user experience.
    • Provide technical support.
    • Debug user support-related issues.
    • Provide safety and security measures.
    • Comply with applicable laws.
    • Fulfill statutory compliance requirements.
    • Understand the effectiveness of the NEEV program.
    • Design future programs.
    • Report on the program to donors.

    2. Disclosure of Personal Data

    The personal data collected by HLF shall not be disclosed to any other organization except where:

    • The disclosure has been agreed to in a written contract or otherwise (e.g., electronic consent) between HLF and you.
    • HLF may disclose your personal data to a third party on a need-to-know basis, provided that HLF informs such third party of the confidential nature of the personal data and requires the same standards of information and data security.
    • HLF may outsource the processing of certain functions and/or information to third parties and disclose your personal data to them solely to carry out the agreed functions.
    • HLF ensures that such third parties provide the same level of protection as HLF, implement appropriate security measures, and are prohibited from using your personal data for their own purposes or disclosing it to others.
    • HLF reserves the right to disclose personal data in its custody if required by a court of law, requested by a government authority, or if necessary to comply with applicable laws or to protect or defend HLF's rights or property.

    3. NOTICE & CONSENT

    Consent - By using the App or by agreeing to transact with us, you agree that HLF shall collect Personal Data from you directly or indirectly and use, process, store, archive, share or disclose the same for the purposes stated herein

    Parental Consent in case of personal data of minors

    As a part of its support initiatives, HLF App may collect and process personal data including personal data relating to children/minors through its authorised coaches/representatives (Authorised personnel). Personal data of minors is collected directly by the Authorised personnel from the parent of lawful guardian of the child/minor after obtaining written consent from the Parent/Guardian.

    Prior to collecting or processing a child’s personal data, the HLF through its Authorised personnel obtains written consent from the Parent/Guardian through physical consent forms.

    By providing such consent, the Parent/Guardian:

    • Confirms that they are legally authorised to provide consent on behalf of the child.
    • Consents to the collection, storage, digitisation, upload, and processing of the child’s personal data by HLF and its Authorised Personnel.
    • Acknowledges that the consent form and related records may be stored digitally within HLF’s systems or applications.
    • Understands the purposes for which the child’s personal data will be used.

    HLF may retain copies of signed consent forms for compliance, record-keeping and audit purposes

    Wherever you have given explicit consent to process personal data for specific purposes, it serves as the legal basis for the processing of personal data.

    In principle, HLF collects and uses your personal data only for the purposes defined herein. The processing of your personal data takes place either on the basis of your consent or to the extent as the law allows this data processing even without consent.

    Processing of personal data is also undertaken if HLF has to comply with a legal obligation. Processing of personal data is also undertaken by HLF if processing is necessary for the purposes of the legitimate interests pursued by HLF.

    While entering into a contract, you must provide the personal data that is necessary to establish, implement and terminate the contract and to satisfy the resulting duties or that HLF must collect due to legal provisions. The purposes of data processing are governed by the respective contract documents and the subject matter of the contract. If we provide you with services on this App that you can voluntarily use, there is no duty to provide your data to us, but without your personal data, you may not be able to use or benefit of our offers and services.

    You have the right to withdraw consent at any time with same level of ease with which you gave consent. Such withdrawal of consent will not affect the legality of processing of the personal data based on consent before its withdrawal. Your personal Data shall be deleted after withdrawal of consent unless HLF has to retain it under any legal obligation

    4. QUESTIONS OR COMPLAINTS REGARDING ACCESS TO PERSONAL DATA

    5. DATA ERASURE AND RETENTION PERIOD

    The information/data submitted by You shall be held as per the data retention policies of HLF and as required by law.

    HLF App processes and stores your personal data for as long as this is necessary to satisfy the respective purpose. If your data is no longer required to fulfill the purpose of the data processing, it will be deleted, unless this deletion is subject to statutory retention obligations.

    The data that you have given us, when submitting consent will be deleted after __31__days at the latest upon request, otherwise we will delete such data pertaining to you after __3___ years at the latest.

    6. Review and Correction

    You may review and amend your personal data provided by you and ensure that any personal data found to be inaccurate or deficient shall be amended or corrected by You. HLF shall not be responsible in any manner for the authenticity of the personal data supplied by You.

    7. REASONABLE SECURITY PRACTICES

    The security of personal data is a priority and is protected by maintaining physical, electronic, and procedural safeguards that meet applicable laws. HLF shall take reasonable steps and measures to protect the security of your personal data from misuse and loss, un-authorized access, modification or disclosure. HLF maintains its security systems to ensure that your personal data is appropriately protected and follows the extant standard encryption norms followed for the transmission of information. HLF ensures that its employees and affiliates respect the confidentiality of any personal data held by HLF.

    HLF is not liable for any loss of any personal data provided by you, due to reasons or causes or conditions beyond its control including but not limited to corruption of data, strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities

    8. Cookie Policy

    HLF App uses various third party analytical tools. These tools use cookies which are downloaded to your device when you visit the mobile application in order to provide a personalized browsing experience. Cookies are used for lots of tasks like remembering your preferences & settings, provide personalized browsing experience and analyze platform operations. These cookies collect information about how users use the HLF App, for instance, how often visited the platform. All information collected by third party cookies is aggregated and anonymous. By using our HLF App user/s agree that these types of cookies can be placed on their device. User/s is free to disable/delete these cookies by changing their device / browser settings.HLF is not responsible for cookies placed in the device of user/s by any other website and information collected thereto.

    9. REDRESSAL OF GRIEVANCE

    • Should you have any grievance regarding the performance of HLF’s obligations in relation to the personal data provided by you or the exercise of your rights under the Policy or provisions of the DPDPA, or in respect of any act or omission of HLF OR ;

    You may contact, the Grievance Officer appointed by HLF. HLF will use reasonable efforts to respond promptly to any requests, questions or concerns or resolve your grievance, which you may have regarding our use of your personal data
